The Promo Addict Terms of Service

These Terms of Service (“Terms”) govern your use of The Promo Addict website, the ordering of goods and services, and any related services we provide. By using our site or placing an order, you agree to these Terms. If you do not agree with any part of these Terms, do not use the site or place an order.

1. Who We Are & How to Contact Us

The Promo Addict Inc. provides promotional products, custom printing and design services through our website and/or storefront.

2. Orders & Approval

  • When you place an order, you’re making an offer to purchase the products or services listed, under the terms herein.
  • All orders are subject to acceptance by The Promo Addict. We will confirm acceptance by sending you an order confirmation via email.
  • For any custom artwork or design (“artwork”), we require your approval via a proof (“e‐proof”) before production. Once you approve, production begins, and you assume responsibility for any errors (text, fonts, colors, layout, etc.).

3. Pricing & Payment

  • All prices are listed in [CAD] and are subject to change without notice until your order is confirmed.
  • You are responsible for paying applicable taxes, shipping fees, and any duties or import fees (if shipping internationally).
  • If using a credit card, a 2.4% fee will be charged on final billing.
  • Payment terms are Due on Receipt of invoice unless credit terms are established independently with The Promo Addict inc by way of a credit application.
  • Invoices will be sent once order is confirmed.

4. Production, Shipping, & Delivery

  • Estimated production times will be listed with each product. These estimates apply once artwork is approved and all order details are finalized.
  • Shipping/delivery times are separate and depend on carrier, shipping method chosen, and destination. We are not responsible for delays caused by carriers, customs, or other third‐party interruptions.
  • Shipping costs, including to The Promo Addict and to the customer are the responsibility of the customer.  Shipping can be provided as a quote prior to finalizing your order, but will be added to the final invoice regardless of if a quote is provided in advance.
  • You must provide correct shipping address and ensure someone is available to receive the shipment or make necessary arrangements. If an item is returned because of an incorrect or incomplete delivery address provided by you, redelivery or re‐shipping costs will be your responsibility.
  • The Promo Addict reserves the right to ship up to 10 % over or under the amount of product ordered.  This is to ensure strict Quality Assurance standards.

5. Returns, Refunds & Cancellations

  • Cancellations or Changes: Orders may be cancelled or changed up until production starts. Once production has begun (including after artwork approval), you generally cannot cancel.
  • Errors & Defects: If there is an error from our side (e.g. print mistake, manufacturing defect), contact us within 3 days of delivery with photos. We will, at our option, replace or refund the affected item(s).
  • Custom/Personalized Items: These are non‐returnable unless there is an error we caused. Because of their customized nature, items made to your specifications can’t be resold, so refunds are limited.

6. Artwork & Intellectual Property

  • You must own or have license to use any artwork, images, fonts, trademarks, or designs you submit. Promo Addict is not responsible for obtaining permissions, and you indemnify us if we are sued because of infringement.
  • By submitting artwork, you license The Promo Addict to use it for the purpose of fulfilling your order.
  • We reserve the right to refuse artwork or orders that contain offensive, illegal, or infringing content.

7. Limitation of Liability & Warranties

  • No warranty: Products, services, and the website are provided “as is” without warranty of any kind, express or implied (including merchantability, fitness for a particular purpose).
  • Limitation of damages: To the maximum extent permitted by law, The Promo Addict will not be liable for indirect, special, incidental, or consequential damages (including lost profits), even if advised of them.
  • Our total liability for any claim arising out of or related to your order is limited to the purchase price of the product(s) in question.
  • For customer supplied products, we accept no liability for damage to goods during production.

8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Alberta, Canada.
  • Any disputes shall be resolved in the courts located in Edmonton, Alberta. unless otherwise agreed.

9. Changes to Terms

  • The Promo Addict reserves the right to revise or update these Terms at any time. Changes become effective upon posting to the website. It’s your responsibility to review these Terms periodically.

10. Miscellaneous

  • If any part of these Terms is held invalid or unenforceable, the remainder shall survive and remain in effect.
  • You may not assign or transfer your rights under these Terms without our prior written consent; we may assign ours freely.
  • These Terms (together with any policies or documents referenced) constitute the entire agreement between you and Promo Addict regarding your order and use of our site, superseding any prior agreements or communications.
